Terms of Sale
1. Introduction
Welcome to Probioform ("we," "our," or "us"). These Terms of Sale govern the purchase of Probioform ("Product") from our e-commerce store by consumers located in Australia. By placing an order, you agree to be bound by these terms and Australian Consumer Law (ACL).
2. Orders & Payment
2.1. All orders are subject to acceptance and availability.
2.2. Prices are listed in Australian dollars (AUD) and include applicable taxes unless stated otherwise.
2.3. We accept payment via Visa, MasterCard, American Express, Union Pay, JCB card, AfterPay. Payment must be received before dispatch.
2.4. We reserve the right to cancel orders due to pricing errors, stock issues, or suspected fraudulent activity.
3. Shipping & Delivery
3.1. We offer shipping across Australia. Estimated delivery times will be provided at checkout.
3.2. Shipping fees, if applicable, will be displayed before completing your purchase.
3.3. We are not responsible for delays caused by external factors (e.g., courier delays, natural disasters).
3.4. Risk of loss or damage to goods passes to you upon delivery.
4. Returns & Refunds
4.1. Our refund and return policy complies with the Australian Consumer Law (ACL).
4.2. You are entitled to a refund or replacement if the Product is faulty, not of acceptable quality, or does not match its description.
4.3. Items purchased must be returned within fourteen (14) days of the purchase date. Goods returned to us because of change of mind must be unused and in perfect re-saleable condition (including product packaging), otherwise we will not be able to refund you. If you instigate a return due to change of mind, you will be responsible for all associated costs due to returning the item ($20 processing fee as well as any postage).
4.4. If a product is returned to us due to the item not being collected at a collection point or not being delivered, a processing fee of $20 will be charged.
4.5. Due to the nature of our product, the inner plastic bag containing the product liquid might from time to time swell up and look inflated. This is not a product error but occurs due to the natural fermentation process of the product. Refunds will not be accepted if this occurs. To resolve this scenario, the customer can turn the bag upside down and press the tap to let the excess air out of the bag.
4.6. Refund requests will not be accepted if the outer cardboard box is damaged during transport unless the plastic bag inside this cardboard box is damaged and leaking.
4.7. The product liquid should not be transferred from the plastic bag that it comes in. If the customer transfers the liquid to another container, the best-before date is voided.
4.8. To request a return or refund, please contact our customer service team at customerservice@probioform.com.au. Proof of purchase is required.
5. Subscription Purchases
5.1. When you purchase a subscription, you will receive repeat deliveries based on the subscription frequency that you select.
5.2. Your payment details will be stored securely, and you will be charged for each of these deliveries.
5.3. If you want to pause, change, or cancel your subscription, you can do so at any time. Your order confirmation emails contain links to your order, allowing you to manage your subscription.
5.4. You can also log in to your account on our website using the email address you used when placing your subscription order and manage your subscription inside your account area.
6. Consumer Guarantees Under ACL
6.1. ACL provides consumer guarantees that cannot be excluded, including guarantees that products are of acceptable quality and fit for purpose.
6.2. If you experience an issue with the Product, please notify us as soon as possible so we can provide a remedy in line with ACL requirements.
7. Liability & Disclaimer
7.1. To the extent permitted by law, we exclude liability for indirect or consequential loss arising from the use of our Product.
7.2. Probioform is a dietary supplement. Any health-related claims are general in nature and should not replace professional medical advice.
8. Changes to Terms of Sale
8.1. We may update these Terms of Sale at any time. The latest version will be available on our website.
